General Terms and Conditions (GTC)

for orders placed via ms-sucra.de

The contract language is German. Only the German version of these General Terms and Conditions is legally binding. The English version is provided for convenience and information only. In case of any differences between the two versions, the German version shall prevail.

1. Scope and customers

These General Terms and Conditions, in the version applicable at the time of the order, apply exclusively to orders placed through the online shop at ms-sucra.de.

Our online shop is intended exclusively for consumers within the meaning of Section 13 of the German Civil Code (BGB), i.e. natural persons who enter into a legal transaction for purposes that are predominantly outside their trade, business or profession.

Orders through the online shop may only be placed by persons who are at least 18 years of age.

Customers confirm that the information provided during the ordering process is accurate and complete.

3. Products and product information

The presentation of products in our online shop does not constitute a legally binding offer. It is an invitation to place an order.

The essential characteristics of each product are set out in the relevant product description in our online shop.

Product images are used for illustrative purposes. In particular, natural materials such as genuine leather may show slight variations in colour, texture or surface appearance. Such material-specific variations do not constitute a defect provided that they do not impair the agreed characteristics or normal use of the product.

4. Ordering process and conclusion of the contract

You can initially place products in your shopping cart without obligation and review or correct your entries using the correction options provided during the ordering process before submitting your order.

By clicking the appropriately labelled order button during checkout, you submit a binding order for the goods contained in your shopping cart.

After completing your order, you will receive an order confirmation by email. Unless otherwise stated during the ordering process, the purchase contract is concluded when this order confirmation is received.

If, in exceptional circumstances, we are unable to fulfil an order, for example because an item is unavailable, we will inform you without undue delay. Any payments already made will be refunded without undue delay.

5. Storage of the contract text

The order details and these General Terms and Conditions are stored in accordance with the applicable statutory requirements.

The information relevant to your order will be provided to you electronically as part of the order process. These General Terms and Conditions can also be accessed and saved at any time through our online shop.

6. Delivery area, shipping and store pickup

Delivery is currently available within Germany only.

Unless otherwise stated in the relevant offer, we select an appropriate shipping method and carrier. Orders are currently shipped in particular via DHL.

Delivery will be made to the delivery address provided by you during the ordering process.

Alternatively, you may choose to pick up your order free of charge at our store in Mainz. We will inform you as soon as your order is ready for collection.

7. Shipping costs and delivery times

Shipping within Germany is free of charge.

If separate shipments are required for technical or logistical reasons, you will not incur any additional shipping costs.

Unless otherwise stated in the relevant product offer, the usual delivery time is 4 to 7 business days. Business days are Monday to Friday, excluding public holidays.

8. Pre-orders

Individual products may expressly be offered as pre-orders. These are products that are not immediately ready for dispatch at the time the order is placed.

The expected shipping or delivery period will be stated on the relevant product page.

For a pre-order, the full purchase price is due immediately when the order is placed and will be charged using the payment method selected during checkout.

As long as a pre-order has not yet been dispatched, you may cancel it. Any payments already made will generally be refunded using the same payment method used for the original transaction.

Your statutory rights, in particular your statutory right of withdrawal, remain unaffected. A withdrawal may also be declared before you receive the goods.

9. Prices and payment methods

The prices displayed in the online shop at the time of your order apply. All prices are stated in euros and include the applicable statutory VAT.

We accept the payment methods displayed during checkout.

These may currently include in particular:

  • Credit and debit cards
  • Apple Pay
  • Google Pay
  • Shop Pay
  • Klarna
  • Other payment methods displayed at checkout

The payment methods available for a specific order will be shown during checkout.

10. Retention of title

The goods remain the property of the seller until full payment has been received.

11. Statutory right of withdrawal

Consumers generally have a statutory right of withdrawal for distance contracts. Details are set out in the following withdrawal instructions.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day:

  • on which you, or a third party designated by you who is not the carrier, takes possession of the goods; or
  • in the case of a single order consisting of several goods delivered separately, on which you, or a third party designated by you who is not the carrier, takes possession of the last item.

of your decision to withdraw from this contract by means of a clear statement, for example by a letter sent by post or by email.

You may use the model withdrawal form provided below, although this is not mandatory.

You can also exercise your right of withdrawal online using the “Withdraw from contract” function in the footer of our website. This function takes you to your orders, where you can select the relevant order and submit your withdrawal electronically.

If you use this online function, we will send you confirmation of receipt without undue delay on a durable medium, in particular by email. The confirmation will include information about the content of your withdrawal declaration as well as the date and time at which it was received.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs – except for any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us – without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract.

We will make the reimbursement using the same payment method that you used for the original transaction, unless expressly agreed otherwise with you. In no event will you incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever occurs first.

You must return or hand over the goods without undue delay and in any event no later than fourteen days from the day on which you inform us of your withdrawal from this contract to:

The deadline is met if you send the goods before the fourteen-day period has expired.

For returns from within Germany, we provide a free return label. When you use the return label provided by us, we cover the cost of return shipping.

If you choose to use a different return shipping method yourself, you are responsible for the direct costs incurred as a result.

You are only responsible for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

13. Electronic withdrawal function

For contracts concluded through our online shop for which a statutory right of withdrawal applies, we provide an electronic withdrawal function.

The function is available under the label “Withdraw from contract” in the footer of our website.

Using the withdrawal function, you can provide or confirm the information required to identify you and the relevant order and then submit your withdrawal declaration electronically.

After submitting your withdrawal, you will receive an electronic confirmation of receipt without undue delay on a durable medium. This confirmation will include at least the content of the withdrawal declaration submitted as well as the date and time at which it was received.

The electronic withdrawal function is an additional way of exercising your right of withdrawal. You may continue to exercise your withdrawal right by any other legally permitted method, including by email or post.

14. Return instructions

To make your return as straightforward as possible, we recommend that you:

  • Pack the goods carefully, preferably in their original packaging.
  • Use the return label provided by us for free return shipping within Germany.
  • Where possible, include your order number or other information that allows us to clearly identify your order.

These recommendations are not a requirement for the valid exercise of your statutory right of withdrawal.

15. Statutory warranty rights and complaints

The statutory warranty rights apply to goods purchased from us.

If an item is damaged or defective, or if you receive the wrong item, you can contact us at retoure@ms-sucra.de.

In the case of a justified complaint, we will cover the necessary return shipping costs.

16. Transport damage

If goods are delivered with obvious transport damage, we kindly ask you to report such damage to the carrier where possible and inform us accordingly.

Failure to make such a report or contact us does not affect your statutory rights, in particular your statutory warranty rights.

17. Copyright and intellectual property rights

All content on ms-sucra.de, including in particular texts, photographs, images, graphics, logos and designs, is protected by copyright or other intellectual property rights unless expressly stated otherwise.

Any use, reproduction, modification, distribution or other exploitation beyond the limits permitted by law requires the prior consent of the respective rights holder.

18. Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

19. Applicable law

The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

In relation to consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.

20. Contract language

The language governing the conclusion of the contract is German.

Where we provide an English translation of these General Terms and Conditions, it is provided for information purposes. In the event of any discrepancy between the German and English versions, the German version shall prevail.

21. Final provisions

If any provision of these General Terms and Conditions is or becomes wholly or partially invalid, the validity of the remaining provisions will not be affected. The relevant statutory provisions will apply in place of any invalid provision.
